STUDIO USE TERMS AND CONDITIONS

By enrolling in our classes, you agree to adhere to the Terms and Conditions listed below (referred to as "Terms and Conditions").

If you do not accept any of these Terms and Conditions, please refrain from joining our classes.

We maintain the right to modify, update, or reissue these Terms and Conditions at any point. Any amendments will be displayed on our Website, and you agree to comply with these updates.

References to "we," "us," or "our" throughout these Terms and Conditions pertain to Purity Pilates Pty Ltd and its entities, associates.

 

1. Medical Warning

Before starting any new exercise regimen, it is advisable to consult with your physician or healthcare professional to ensure that you are aware of your current health status and any restrictions that may apply to you.

While participating in our classes, please practice moderation and train at a pace that feels comfortable for you. Cease all activity immediately if you experience any pain or discomfort. Seek medical assistance promptly for any unexpected changes in your physical condition.

Inform your instructor of any pre-existing injuries or medical issues that might affect your engagement in exercises within our classes.

By engaging in any exercise program (including the use of equipment purchased from us), you acknowledge that you do so at your own risk. The creators, producers, instructors, and distributors of our exercise programs (and their representatives) shall not be held liable for any personal injuries, losses, or liabilities resulting from your participation in any such exercise program or from following guidance provided on our website or by our instructors.

 

2. Prices and Booking

Current pricing and schedules are available on our Website. Prices may change from time to time, and any updates will be communicated on the Website.

To enrol in our classes, you are required to set up an account with Momence booking softward. Your account is subject to these Terms and Conditions, our Website Terms of Use, and our Privacy Policy.

Each class has limited spaces available. To attend, you must reserve a spot. You can make bookings online through our website, mobile app, or by contacting your Studio directly via text or email.

 

3. Cancellation Policy

To cancel a booking, you must inform your Studio at least 12 hours before the class starts. Cancellations made within 12 hours of the class will incur a charge equal to the full cost of the reserved class.

You can cancel bookings online by logging into your account and selecting the option to unreserve the class, or by reaching out to your Studio via email.

If you anticipate that you cannot attend a class you’ve booked, especially close to the 12-hour cancellation window, we recommend cancelling your reservation to allow someone on the waitlist to take your spot on the reformer.

 

4. Class Waitlists

If a class is full, you can join the waitlist! If a spot opens up, you will receive an email notification and will be automatically booked into the class. Remember to check your email for confirmation of your waitlist status.

If you can no longer attend a class for which you are waitlisted, please remove yourself from the waitlist through our website or mobile app. Once confirmed in a class from the waitlist, our 12-hour courtesy cancellation policy applies, and a cancellation fee will be charged if you cancel within this period.

 

5. Class Packs

All classes must be prepaid before participation. This can be done when booking a class, via a prepaid package, or as a casual visitor.

Class packs are non-transferable between individuals and cannot be sold, traded, gifted, shared, or otherwise transferred to anyone besides the original purchaser.

Every class pack comes with a firm expiration date. If the allotted classes are not utilised by the expiration date, those sessions will become void, and no refunds will be issued for any unused classes.

The sale of class packs is final. Purity Pilates does not provide refunds, transfers, suspensions, or extensions for packs due to illness, injury, change of mind, user error, relocation, or any other reason.

Current pricing and validity periods for various class packs can be reviewed on our website and may be subject to change.

 

6. Referral Credit

Occasionally, we may offer credits to current members for referring new clients to our Studio. This credit can be applied toward the purchase of a class pack and is not cash redeemable.

 

7. Gift Vouchers

Our Studios may occasionally sell gift vouchers. Additionally, gift vouchers may be distributed free of charge or as incentives during promotional events or campaigns.

Gift vouchers are limited to their stated dollar value and cannot be exchanged for cash.

We are not liable for lost or stolen gift vouchers. All gift vouchers come with a strict expiration date, and any unclaimed balances are non-refundable.

Gift vouchers cannot be returned, resold, or used for unauthorised advertising or promotional activities.

 

8. Class Schedules

Class schedules may vary and are subject to change or cancellation without prior notice.

We are not liable to provide refunds, credits, transfers, or any form of compensation for classes not held as per the scheduled time, including any that are altered or cancelled.

We reserve the right to adjust our Studio operating hours at any time without notice. Any permanent changes to business hours will be communicated to you.

9. Conditions of Entry

Purity Pilates reserves the right to refuse entry to or remove any individuals from our Studios who behave inappropriately, are intoxicated, disorderly, aggressive, or present a risk to the safety of others.

To minimise disruptions, please aim to arrive at least 5 minutes before the scheduled start time of your class.

Students are discouraged from leaving classes early as it can disturb fellow participants’ experiences.

Smoking is strictly prohibited inside and outside our Studio.

All participants are expected to show respect for everyone and everything within our Studio.

Clients should wear suitable exercise attire during their visits, avoiding clothing with offensive designs that may pose safety risks.

For hygiene reasons, socks highly recommended during your workout. Specialised Pilates grip socks can be purchased on-site for $20.

To ensure an enjoyable experience for all, please turn off your mobile devices before your class.

10. Personal Safety and Acceptance of Risk

By participating in our Pilates classes, you acknowledge that you are engaging in physical activities that inherently carry a risk of injury. Your participation is at your own risk.

You must inform your instructors of any health risks that may arise from your participation in Pilates, including but not limited to existing injuries, illnesses, soreness, or pregnancy prior to starting. Engaging in exercise at our Studio with a medical condition is done entirely at your own risk.

You understand that your involvement in any exercise regime at our Studio may involve various risks, including the potential for personal injury.

Our Pilates instructors do not possess medical training outside current first aid and thus cannot ascertain whether clients are in a suitable physical condition to partake in exercise activities without adverse effects. Clients are advised to obtain medical advice before starting any exercise program should there be any uncertainty regarding their capability to engage in exercise.

By participating in our classes, you agree that our liability concerning recreational services (as defined in section 139A of the Competition and Consumer Act 2010 (Cth)) for any occurrence of death, physical or mental injury, disease, or any damaging event that may arise as a result of receiving recreational services is explicitly excluded, except when significant personal injury arises from the reckless behaviour of Purity Pilates in providing such services.

You also acknowledge that our instructors may use tactile guidance and adjustments or make physical contact with you for correction purposes to ensure exercises are performed safely and according to Purity Pilates best practices.

 

11. Pregnancy

Our standard classes are suitable for women until the 14-week mark of pregnancy. After this time, you are required to discontinue attendance in regular classes.

Specialised Pregnancy classes are available upon request and are safe for women to join throughout their entire pregnancy, as long as they feel comfortable.

12. Security

Purity Pilates is not liable for the safekeeping of your personal belongings brought into our Studios. Therefore, we strongly recommend that you:

i. Avoid bringing any valuable items, such as mobile phones, jewellery, devices, wallets, bags, or purses, into our Studio;

ii. Limit your personal belongings to only those necessary during your visit; and

iii. Utilise the storage boxes at the front of the room, the personal shelves next to our mirrors and the hooks provided within the studio for your personal items during your stay.

 

13. Misuse of Class Packs

We reserve the right to suspend or terminate your access to any Purity Pilates class packs if we suspect any fraudulent activity or misuse of our booking system.

 

14. Payment

You are responsible for ensuring that there are ample funds in your chosen bank account or credit card to cover any purchases made for class packs or other products.

Should a payment be declined for any reason, we reserve the right to initiate payment processing when sufficient funds are available to settle outstanding fees. If an auto-debit fails due to insufficient funds, our payment processor may impose charges for failed transactions. This fee will be applied to your account approximately 7 days after the unsuccessful payment attempt.

We do not assume any responsibility for additional fees incurred by you from your bank regarding the processing of fees.

 

16. Your Personal Information

Your personal information, collected in accordance with these Terms and Conditions, will always be handled according to our Privacy Policy, which you can view in its entirety here.

 

17. Limitation of Liability

Except where legally required otherwise, Purity Pilates (including its officers, employees, and agents) disclaims all liability (whether under contract law, tort law, or otherwise) for any personal injury, loss, or damage (including but not limited to loss of opportunity, reputation, privacy, or data), whether direct or indirect, as a result of your attendance in our classes. This includes, but is not limited to, theft, unauthorised access, or third-party interference.

This limitation of liability applies even if Purity Pilates has been explicitly informed of potential losses.
